Regional City Updates

There have been some interesting updates on legal cases filed by rental property owners against the city of Santa Ana and its rent control ordinance. The Apartment Association of Orange County (AAOC) has a case pending where the judge has ruled on one issue – the rent board make up is unconstitutional. As of the writing of this report, the judge has not ruled on the balance of the case. Meanwhile, Santa Ana Park Owner Kim Eggleston, after years of hearing officer hearings and appeals since filing for a base year rent adjustment on two parks, has filed suit against the City of Santa Ana. 

In a very odd twist of circumstances, on appeal a hearing officer granted the requested rent increases of between $500 and $600 for two separate park applications only to have the city request a reconsideration by the hearing officer who then reversed his decision. Stanton former council member Hong Alyce Van pleaded guilty to not living in the district she was representing. She resigned after the allegation surfaced. 

While on the council, she pursued the adoption of mobile home park rent control. Rancho Cucamonga has had a Memorandum of Understanding (MOU), called an Accord, in place for over 30 years. The park owners are working with the city to extend the Accord for another 10 to 20 years.
